General provisions
1.1.
This Privacy Policy (Personal Data Processing Policy) (hereinafter - the
Policy) defines the procedure for collecting, receiving, registering,
accumulating, storing, adapting, changing, using, transferring, anonymizing, deleting and protecting
the personal data of individuals who visit the website https://spc.com.ua/ and all its derivative URL addresses, pages,
use its functionality, create an account, place an order, contact via feedback
forms or otherwise interact with the Company with limited liability
"PNEVMOPRIVOD", using the commercial name "Spe cialist " (hereinafter - Seller, Company, Owner
of personal data) in connection with service and sales .
1.2. This Policy is an integral document
related to the Public Offer of the online store, the rules and conditions for
returning goods, as well as other documents governing the use of the Site,
registration, payment, delivery, return of goods and communication between the
User and the Seller.
1.3. This Policy applies to all cases of
personal data processing carried out by the Seller in connection with:
1.3.1. visiting and using the website https://spc.com.ua/ , including its individual pages, services,
sections, product catalog, basket, personal account, feedback forms and other
functional elements of the Site;
1.3.2. the User's registration on the Site,
logging into the account, using the functions of the personal account, viewing
the order history and saving the user's settings;
1.3.3. processing, confirmation, payment,
execution, tracking, delivery, return or cancellation of orders for goods
placed on the Site;
1.3.4. submissions, requests, messages,
claims, claims or other communications addressed to the Seller via the Site,
e-mail, telephone, messengers, social networks or other communication channels
used by the Seller in the scope of business activities;
1.3.5. by the User receiving consultations,
information messages, service messages, messages about the status of the order,
product availability, specification of characteristics, payment methods, terms
of delivery, return or warranty service.
1.4. This Policy is drawn up in accordance
with the Constitution of Ukraine, the Civil Code of Ukraine, the Law of Ukraine
"On Protection of Personal Data", the Law of Ukraine "On
Electronic Commerce", the Law of Ukraine "On Protection of Consumer
Rights", as well as other normative legal acts of Ukraine regulating
relations in the sphere of personal data protection, electronic commerce and
distance selling of goods.
1.5. In the event that the norms of foreign
legislation or international data protection standards, including the
legislation of the European Union, are subject to application to certain legal
relationships connected with the use of the Site or the processing of personal
data, the processing of personal data is also carried out taking into account
such requirements in the applicable part.
1.6.
Using the Site, creating an account, placing an order, filling out any forms on
the Site, contacting the Seller, as well as the other knowing provision of
personal data by the User means that the User has familiarized himself with
this Policy and agrees to the procedure for processing his personal data under
the conditions defined by this Policy.
1.7.
If the User does not agree with
the terms of this Policy, he must refrain from using the Site in the part that
provides for providing personal data, registering an account, placing an order
or sending any communications to the Seller through electronic communication
channels.
1.8. This Policy applies exclusively to the
website https://spc.com.ua/ , including its main page, all existing and
future web pages, sections, subsections, functional elements, as well as other
derivative URLs related to it, and does not apply to websites, services,
software products or other information resources.
1.9.
The Seller processes only those personal data that are necessary, relevant and
sufficient to achieve the goals defined by this Policy, taking into account the
nature of the legal relationship with the User, the functionality of the Site,
the content of the order, the method of communication and the requirements of
the law.
1.10.
This Policy shall be publicly available on the Site and shall enter into force
from the date of its publication, unless a second effective date is specified
in the Policy text.
2.
Terms and definitions
2.1.
Personal data – information or a set of information about an individual who is
identified or can be specifically identified.
2.2.
Processing of personal data – any action or set of actions on personal data,
including collection, registration, accumulation, storage, adaptation,
modification, use, distribution, depersonalization, destruction.
2.3.
The owner of personal data is the Seller who determines the purpose of
processing personal data, the composition of this data and the procedures for
processing it.
2.4.
User - any natural person who visits the Site, submits an application,
registers, creates an account, places an order, purchases goods or otherwise
interacts with the Seller through the Site.
3.
Composition of personal data that may be processed
3.1.
Personal data provided directly by the User:
3.1.1.
identification data: name, surname, patronymic if available;
3.1.2.
contact data: telephone number, e-mail address, delivery address, postal
address, other contact information necessary for registration, fulfillment and
support of the order;
3.1.3.
account and identification data on the Site: login, password in encrypted form,
user identifier, profile data, order history, saved settings and other data
necessary to use the personal account and the Site functionality;
3.1.4.
data about the order of goods: information about the selected goods, their
quantity, packaging, cost, payment method, delivery method, recipient data,
order status, registration history, execution, cancellation or return of the
order;
3.1.5.
payment and financial data: fact of payment, amount, date, transaction status,
payment identifiers, as well as other information necessary to confirm payment,
create invoices, invoices, deeds, other settlement or accompanying documents in
cases provided by legislation or legal nature;
3.1.6.
data for ordering documents: name of a legal entity or individual entrepreneur,
EGRPOU code or registration number of a taxpayer's account card, location, bank
and other details, if such data are provided by the User for ordering or
accompanying documents;
3.1.7.
communications: the content of requests, applications, notifications, claims,
reviews, correspondence with the Seller, as well as other data that the User
voluntarily discloses when interacting with the Seller;
3.1.8.
marketing settings: the fact of granting or withdrawing consent to receive
informational, advertising or marketing messages, as well as information about
subscribing to or unsubscribing from such messages.
3.2.
Data that may be collected automatically when using the Site:
3.2.1.
technical data: IP address, browser type and version, device type, operating
system, interface language, time zone, technical connection parameters;
3.2.2.
data about activity on the Site: date and time of visit, viewed pages,
transitions between pages, clicks, traffic sources, session duration, used Site
functions;
3.2.3.
cookies and other similar technologies used to ensure the Site works, save
settings, analytics, statistics and improve the user experience.
3.3.
Information received from third parties:
3.3.1.
when placing an order by a representative of a legal entity, an individual
entrepreneur or another authorized person - the data necessary for the proper
registration, execution and monitoring of such an order;
3.3.2.
in the case of payment, delivery, return of goods or other support of the order
with the involvement of third parties - information received from payment
services, banks, delivery services, postal operators or other contractors
within the limits necessary for order fulfillment, confirmation of payment,
delivery or return;
3.3.3.
other information obtained from open sources or from third parties on legal
grounds, if it is necessary for the proper execution of the order,
consideration of the User's request, protection of the Seller's rights, or
compliance with the requirements of the law.
3.4.
The seller does not set the purpose of processing special categories of
personal data, in particular, data on racial or ethnic origin, political,
religious or ideological beliefs, membership in political parties or trade
unions, health status, sexual life, biometric or genetic data, unless otherwise
expressly provided by the legislation of Ukraine or does not follow from the
law.
4.
Purpose of personal data processing
4.1.
Personal data is processed for the purpose of:
4.1.1.
ensuring the proper functioning of the Site, creation, registration,
administration and maintenance of the User's account, his identification,
authentication and provision of access to the relevant functionality of the
Site;
4.1.2.
acceptance, processing, confirmation, execution, maintenance, modification,
cancellation and accounting of orders for goods placed on the Site;
4.1.3.
conclusion and execution of contracts, including a public offer, issuing
invoices, invoices, other accompanying, settlement or primary documents, as
well as keeping internal records of transactions;
4.1.4.
organization and provision of acceptance of payments, confirmation of the fact
of payment, interaction with payment services, banking institutions and other
persons involved in settlement;
4.1.5.
organization of delivery of goods, transfer of orders to the recipient,
coordination of interaction with delivery services, postal operators and other
contractors involved in the execution of the order;
4.1.6.
providing the User with information, consultations, responses to inquiries,
processing of requests, messages, claims, requests regarding goods, terms of
order, payment, delivery, return, warranty or service;
4.1.7.
sending service, technical and organizational messages, including messages
about the status of the order, confirmation of registration, changes in the
operation of the Site, account security, terms of order fulfillment or other
messages directly related to the use of the Site or the fulfillment of
contractual obligations;
4.1.8.
consideration of issues related to the return of goods, replacement of goods,
warranty cases, service support, as well as the settlement of possible disputes
between the User and the Seller;
4.1.9.
sending informational, advertising, marketing and other commercial
notifications about goods, promotions, special offers, news, assortment updates
and other offers of the Seller in the event of the corresponding consent of the
User or another appropriate legal basis;
4.1.10.
conducting analytics, statistical studies, monitoring the Site's performance,
improving its functionality, content, technical capabilities, user experience,
service quality and communication efficiency with Users;
4.1.11.
ensuring information security, detection and prevention of fraud, misused,
unauthorized access, illegal use of the Site, as well as other actions that may
violate the rights and legitimate interests of the Seller, Users or third
parties;
4.1.12.
fulfillment of the requirements of the legislation of Ukraine, including in the
field of accounting, taxation, consumer rights protection, electronic commerce,
as well as fulfillment of legal requirements, requests, decisions or
prescriptions of authorized state bodies;
4.1.13.
protection of the rights, legal interests and business reputation of the Seller
within the scope of pretentious, contractual, administrative, executive,
judicial or other law enforcement activities.
5.
Legal basis of processing
5.1.
Processing of personal data is carried out on one or more of the following
legal grounds:
5.1.1.
the consent of the subject of personal data, in particular in cases where such
consent is necessary for sending marketing, advertising or informational
messages, using cookies and other similar technologies, as well as in other
cases provided by law;
5.1.2.
the need to conclude, execute and maintain a contract to which the subject of
personal data is a party, including a public offer, registration, payment,
delivery, return, replacement of goods, warranty or service order;
5.1.3.
fulfillment by the Seller of obligations established by the legislation of
Ukraine, in particular in the field of accounting, taxation, electronic
commerce, protection of consumer rights, as well as fulfillment of legal
requirements of authorized state authorities;
5.1.4.
the legitimate interest of the Seller, which consists, in particular, in
ensuring the proper functioning of the Site, information and technical
security, prevention of fraud, abuse and unauthorized use of the Site, internal
reporting, improvement of service quality, development of the Site and
protection of the rights and legitimate interests of the Seller, provided that
the balance between personal and personal interests is observed.
5.2.
If the processing of personal data is carried out on the basis of the consent
of the subject of personal data, such consent may be revoked by him at any time
by contacting the Seller using the contact details specified in this Policy, if
the other way of withdrawing consent is not provided by the functionality of
the Site or the corresponding service.
5.3.
The withdrawal of consent to the processing of personal data does not affect
the legality of the processing carried out until the moment of its withdrawal,
and also does not affect the processing of personal data carried out by the
Seller on other legal grounds provided for by legislation or this Policy.
6.
Period of storage of personal data
6.1.
Personal data are stored no longer than is necessary to achieve the purpose of
their processing, to fulfill contractual obligations, to ensure proper
functioning of the Site, to consider requests from Users, and also within the
time limits established by the legislation of Ukraine.
6.2.
As a guide, personal data may be stored for the following periods:
6.2.1.
the User's account data, profile data, order history and other information
related to the use of a personal account on the Site - during the account's
existence and additionally within a reasonable period after its deletion to
confirm the fact of placing and fulfilling orders, considering possible
appeals, claims or disputes, as well as protecting the rights and legitimate
interests of the Seller;
6.2.2.
personal data related to registration, payment, execution, delivery, return,
replacement of goods, warranty or service - during the period necessary to
fulfill the corresponding order and during the subsequent period necessary to
comply with the requirements of the law, accounting, tax and other mandatory
accounting, as well as to protect the rights and legitimate interests of the
Seller;
6.2.3.
data contained in appeals, requests, complaints, claims, correspondence and
other communications with the User - during the period necessary to provide an
answer, settle the relevant issue and, if necessary, during an additional
period to confirm the content of the communication and protect the rights of
the parties;
6.2.4.
data regarding marketing, advertising and informational newsletters, as well as
information about consents given or refusals to receive them - until the moment
of withdrawal of the corresponding consent, unsubscription of the User or
termination of the corresponding purpose of processing, as well as within a
reasonable period after this to record the fact of withdrawal of consent or
refusal of the newsletter;
6.2.5.
technical data, analytics data, cookies and other similar information - during
the period necessary to ensure the functioning of the Site, save the User's
settings, keep statistics, analytics, improve the operation of the Site and
achieve other goals defined by this Policy, if the second period does not
result from browser or cookie settings.
6.3.
In cases where the storage of individual personal data is necessary to fulfill
the requirements of the law, consider a dispute, protect the rights and
legitimate interests of the Seller, comply with a court decision, request an
authorized body or complete an inspection, such data may be stored longer than
the terms specified in clause 6.2 of this Policy, but only for the time
necessary to achieve the relevant purpose.
6.4.
After the expiration of the storage period, personal data are subject to
deletion, destruction or depersonalization, unless otherwise established by the
legislation of Ukraine or necessary to protect the rights and legitimate
interests of the Seller.
7.
Disclosure and transfer of personal data to third parties
7.1.
The transfer of personal data to third parties may be carried out by the Seller
only in the cases, to the extent and in the order necessary to achieve the
purpose of personal data processing, fulfillment of contractual obligations,
proper functioning of the Site, compliance with the requirements of the
legislation of Ukraine or protection of the rights and legitimate interests of
the Seller, in particular:
7.1.1.
to service providers, contractors and contractors of the Seller, including
persons providing hosting, technical support, operation of the Site, CRM

requirements;

to a legal successor or a second person in case of reorganization, alienation
of business, transfer of corporate rights, assets, or changes in the structure
of the Seller's economic activity - while ensuring an adequate level of
personal data protection.
7.2.
The Seller does not sell personal data to third parties.
7.3.
Access to personal data is provided to employees, representatives, contractors
and other involved persons exclusively on the principle of service necessity
and within the limits necessary to achieve the goals of processing such data.
7.4.
The seller takes reasonable organizational and legal measures to ensure that
the persons to whom personal data is transferred use it exclusively for
specific purposes, to the extent necessary and in compliance with the
requirements of confidentiality and legislation on the protection of personal
data.
8.
Cookies and similar technologies
8.1.
The site may use cookies and similar technologies to:

and takes reasonable legal, organizational and contractual measures to maintain
the confidentiality and security of such data.

Safety measures
10.1.
The seller applies legal, organizational and technical measures to protect
personal data, in particular:
10.1.1.
access limitation and rights control;
10.1.2.
secure data transmission channels (for example, HTTPS);
10.1.3.
backup and monitoring;
10.1.4.
internal access policies and personnel training;
10.1.5.
confidentiality agreements with employees and contractors.
10.2.
Absolute security on the Internet cannot be guaranteed, however, the Seller
takes reasonable measures to minimize risks.
11.
Rights of the subject of personal data
11.1.
The subject of personal data has the rights provided for by the legislation of
Ukraine, including Art. 8 of the Law of Ukraine "On Protection of Personal
Data", in particular the right:
11.1.1.
know about the sources of collection, location of personal data, purposes of
processing;
11.1.2.
to receive information about the conditions of access to data, including third
party recipients;
11.1.3.
access to your personal data;
11.1.4.
receiving a response to the fact of processing and content of personal data in

12.
Children's data
